1. Acceptance of Terms
By scheduling an appointment, visiting our locations, or using our services, you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
ABQ Fingerprinting ("we," "us," "our," or "Company") reserves the right to modify these Terms at any time. Your continued use of our services after changes constitutes acceptance of the modified Terms.
2. Services Provided
ABQ Fingerprinting provides professional fingerprinting and background check services throughout New Mexico, including:
Core Services

Digital Fingerprinting: Electronic capture of fingerprints using LiveScan technology

Fingerprint Cards: Traditional ink-based fingerprint cards printed on-site

FBI Background Checks: Criminal history record checks processed through the FBI
-
ATF EFT (Electronic Fingerprint Transmission): Fingerprinting for firearms-related applications
-
FDLE Fingerprinting: Florida Department of Law Enforcement background checks
-
Live Scan Services: Real-time electronic fingerprint transmission to government agencies
-
FBI Apostille Services: Authentication of FBI background check documents for international use (completed after FBI background check)

3. Eligibility
To use our services, you must:

Be at least 18 years of age, OR be accompanied by a parent or legal guardian

Provide valid government-issued identification

Provide accurate and complete information
-
Have legal authority to submit fingerprints for the stated purpose
Services for minors require parental or guardian consent and presence during the appointment.
4. Appointments and Scheduling
Scheduling

Appointments can be scheduled online through our website or by phone

Walk-in services may be available but are not guaranteed

Appointment times are subject to availability
Confirmation

You will receive appointment confirmation via email or phone

It is your responsibility to arrive on time for your scheduled appointment
Required Documents
You must bring to your appointment:

Valid government-issued photo identification (driver's license, passport, state ID, or military ID)

Any required application forms or authorization documents

Payment for services
Late Arrivals and Missed Appointments

If you arrive more than 15 minutes late, we reserve the right to reschedule your appointment

Missed appointments without 24-hour advance notice may result in forfeiture of any deposit or prepayment
5. Fees and Payment
Service Fees

Fees for services are posted on our website and at our locations

Prices are subject to change without notice

Some services require payment to government agencies in addition to our service fees
Payment Methods
We accept:

Credit and debit cards (Visa, Mastercard, American Express, Discover)

Cash (at physical locations)

Electronic payments through our online booking system
Payment Terms

Payment is due at the time services are rendered unless otherwise arranged

For FBI Apostille services, initial FBI background check must be paid before Apostille processing can begin

All fees are in U.S. dollars
Refund Policy
-
Service Fees: Non-refundable once fingerprinting services have been completed
-
Rejected Fingerprints: If your fingerprints are rejected by the FBI or other agency due to poor quality, we will provide ONE (1) free resubmission. Any subsequent resubmissions will be charged at the posted rate
-
Cancelled Appointments: Cancellations made at least 24 hours in advance may be eligible for a refund or credit, minus any processing fees
-
Government Fees: Fees paid to government agencies (FBI, ATF, FDLE, etc.) are non-refundable
-
Technical Issues: If we are unable to capture usable fingerprints due to our equipment failure, you will receive a full refund
6. Service Limitations and Disclaimers
Our Role

We are a fingerprinting service provider, NOT the decision-making authority
-
We capture and transmit fingerprints; we do NOT determine eligibility, approval, or denial of applications
-
Results are provided by the requesting agency (FBI, ATF, employer, etc.), not by us
No Guarantee of Results
-
We do NOT guarantee any particular result or outcome from your background check
-
We do NOT guarantee acceptance of your fingerprints by receiving agencies
-
Processing times are determined by government agencies and are beyond our control
FBI Channeling Service
-
FBI Channeling is a NON-REFUNDABLE service
-
Processing times vary and are controlled by the FBI, not ABQ Fingerprinting
-
We cannot expedite FBI processing
Quality Standards
-
We use industry-standard LiveScan technology to capture high-quality fingerprints
-
We will make reasonable efforts to ensure fingerprint quality meets FBI and agency standards
-
Some individuals have fingerprints that are difficult or impossible to capture due to age, occupation, medical conditions, or other factors beyond our control
7. Customer Responsibilities
You agree to:

Provide accurate, complete, and truthful information
-
Present valid identification at your appointment
-
Comply with staff instructions during fingerprinting
-
Notify us immediately of any errors in your submitted information
-
Review all documents before signing
-
Understand that FBI Channeling and background checks are subject to FBI policies and timelines
You acknowledge that:

Providing false information may result in denial of service and potential legal consequences
-
You are responsible for understanding the requirements of your requesting agency
-
Results are provided directly by the requesting agency, not by ABQ Fingerprinting
8. Privacy and Data Security
Your privacy is important to us. Our collection, use, and protection of your personal information and fingerprints are governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using our services, you:

Consent to the collection and processing of your fingerprints and personal information

Authorize us to transmit your information to the FBI, ATF, FDLE, and other authorized agencies
-
Understand that your fingerprints may be retained in FBI databases as described in our Privacy Policy

Acknowledge receipt of the FBI Privacy Act Statement and Non-Criminal Justice Applicant's Privacy Notice
9. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of ABQ Fingerprinting or its licensors and is protected by U.S. and international copyright laws.
You may not:

Copy, reproduce, or distribute our content without permission

Use our trademarks or branding without authorization
-
Reverse engineer or attempt to extract source code from our systems
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
General Limitations
ABQ Fingerprinting SHALL NOT BE LIABLE FOR:

Delays or failures in processing caused by government agencies
-
Decisions made by employers, licensing boards, or other requesting organizations based on background check results
-
Rejection of fingerprints due to individual fingerprint characteristics
-
Indirect, incidental, special, consequential, or punitive damages
-
Loss of income, employment opportunities, or other economic losses resulting from background check results
Maximum Liability
Our total liability to you for any claims arising from our services shall not exceed the amount you paid for the specific service that gave rise to the claim.
Exceptions
Nothing in these Terms shall limit our liability for:

Death or personal injury caused by our negligence

Fraud or fraudulent misrepresentation
-
Any liability that cannot be excluded or limited by law
11. Indemnification
You agree to indemnify, defend, and hold harmless ABQ Fingerprinting, HTM Security Services, and their officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

Your use of our services

Your violation of these Terms
-
Your violation of any rights of another person or entity
-
Your provision of false or misleading information
12. Governing Law and Dispute Resolution
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions.
Jurisdiction
Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to personal jurisdiction in such courts.
Dispute Resolution
Before filing any legal action, you agree to:

Allow us 30 days to attempt to resolve the issue

Participate in good faith negotiations
Arbitration
For disputes that cannot be resolved through negotiation, you agree to binding arbitration in accordance with the American Arbitration Association's rules, with the arbitration to take place in Albuquerque, New Mexico.
13. Partner Location Operations
ABQ Fingerprinting operates through partnerships with local businesses at several locations throughout New Mexico. These partnerships involve:

Partnership Structure:

Partner businesses provide the physical location and facility

ABQ Fingerprinting provides LiveScan equipment and technical services

Both entities share responsibility for service delivery and customer service

All locations adhere to the same quality, privacy, and service standards
Services provided at partner locations are subject to these Terms and are provided under the ABQ Fingerprinting brand. Your experience and rights as a customer are consistent across all locations.
14. Prohibited Conduct
You may NOT:

Use our services for any unlawful purpose
-
Provide false or misleading information
-
Attempt to use another person's identity
-
Interfere with or disrupt our services or systems
-
Harass, threaten, or abuse our staff
-
Attempt to gain unauthorized access to our systems or data
-
Use our services to harm, defraud, or deceive others
Violation of these prohibitions may result in:

Termination of services
-
Denial of future services
-
Reporting to law enforcement
-
Legal action to recover damages
15. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including:

Acts of God (earthquakes, floods, fires, etc.)

War, terrorism, or civil unrest
-
Government actions or regulations
-
Labor disputes or strikes
-
Pandemics or public health emergencies
-
Failures of telecommunications or internet services
-
Government agency system outages or technical issues
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ABQ Fingerprinting regarding our services and supersede all prior agreements, understandings, and communications.
18. Waiver
Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or our right to enforce it in the future.
19. Assignment
You may not assign or transfer these Terms or your rights and obligations under them without our prior written consent. We may assign these Terms to any successor or affiliate without restriction.
