When you schedule an appointment or use our services, we collect:

  • Full legal name

  • Date of birth

  • Social Security Number

  • Current and previous addresses

  • Phone number

  • Email address

  • Government-issued identification details

  • Payment information

Biometric Information

  • Fingerprints: Digital and/or card-based fingerprint images captured during your appointment

  • Fingerprint quality data

  • Associated biometric identifiers

Purpose-Related Information

Depending on the service requested, we may collect:

  • Immigration/naturalization details

  • Professional licensing information

  • Security clearance documentation

  • Adoption or foster care application details

  • Firearms purchase information

How We Use Your Information

We collect and use your information for the following purposes:

Primary Purposes

  1. Background Check Processing: Submit fingerprints and associated information to federal and state agencies (FBI, ATF, FDLE, USCIS, etc.) for criminal history record checks

  2. Service Delivery: Process your fingerprinting appointment and provide requested services including:

    • FBI background checks

    • ATF EFT (Electronic Fingerprint Transmission)

    • FDLE fingerprinting

    • Live Scan services

    • FBI Apostille services

  3. Appointment Management: Schedule, confirm, and manage your fingerprinting appointments

  4. Communication: Contact you regarding appointment status, results, or service updates

  5. Payment Processing: Process payments for services rendered

  6. Record Keeping: Maintain records as required by federal and state regulations

Legal Authority

Information collection is authorized under:

  • Title 28, United States Code (U.S.C.) Section 534

  • Privacy Act of 1974, Title 5, U.S.C. Section 552a

  • Title 28, Code of Federal Regulations (CFR), Section 50.12

  • State statutes pursuant to Public Law 92-544

  • Presidential Executive Orders

  • Federal and state regulations governing fingerprint-based background checks

FBI Privacy Act Statement

Authority: Collection of your fingerprints and associated information is generally authorized under 28 U.S.C. 534. Supplemental authorities include federal statutes, state statutes pursuant to Pub. L. 92-544, Presidential Executive Orders, and federal regulations.

Voluntary Submission: Providing your fingerprints and associated information is voluntary; however, failure to do so may affect the completion or approval of your application for employment, licensing, security clearance, or other purposes.

Principal Purpose: Your fingerprints and associated information may be provided to the employing, investigating, or otherwise responsible agency, and/or the FBI for the purpose of comparing your fingerprints to other fingerprint repositories (including civil, criminal, and latent fingerprint databases).

FBI Retention: The FBI may retain your fingerprints and associated information in the Next Generation Identification (NGI) system after the completion of your application. While retained, your fingerprints may continue to be compared against other fingerprints submitted to or retained by NGI.

Routine Uses: During processing and for as long as your information is retained in NGI, your information may be disclosed pursuant to your consent and without your consent as permitted by the Privacy Act of 1974 and all applicable Routine Uses published in the Federal Register. Routine uses include, but are not limited to, disclosures to:

  • Employing agencies (governmental or authorized non-governmental)

  • Agencies responsible for employment, contracting, licensing, and security clearances

  • Local, state, tribal, or federal law enforcement agencies

  • Criminal justice agencies

  • Agencies responsible for national security or public safety

How We Share Your Information

Authorized Disclosures

We share your fingerprints and personal information with:

  1. Federal Agencies:

    • Federal Bureau of Investigation (FBI)

    • Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF)

    • U.S. Citizenship and Immigration Services (USCIS)

    • Department of State (for Apostille services)

    • Other federal agencies as authorized by your application

  2. State Agencies:

    • Florida Department of Law Enforcement (FDLE)

    • New Mexico state agencies as authorized

    • Other state agencies as required by your application

  3. Partner Locations:

    • HTM Security Services (Las Cruces)

    • Beyond Mail and Print (Rio Rancho)

    • C and J Drug Screening (Roswell)

    • DMV Title Experts (Santa Fe)

    • 9 to 5 Ship and Print (Taos)

    • Other authorized fingerprinting service locations

  4. Requesting Organizations:

    • Your prospective or current employer

    • Licensing boards

    • Educational institutions

    • Adoption agencies

    • Other organizations authorized by your application

Legal Requirements

We may disclose your information when required by law, court order, or legal process, or to:

  • Comply with federal or state regulations

  • Respond to lawful requests from public authorities

  • Protect our rights, privacy, safety, or property

  • Enforce our terms and conditions

Data Security

We implement appropriate technical and organizational security measures to protect your personal information and fingerprints, including:

  • Encrypted Transmission: Fingerprints are transmitted to government agencies using secure, encrypted channels

  • Secure Storage: Physical and digital records are stored in secure, access-controlled facilities

  • Limited Access: Only authorized personnel have access to your information

  • FBI Compliance: Our systems and procedures comply with FBI Criminal Justice Information Services (CJIS) Security Policy

  • Regular Audits: Periodic security assessments and compliance audits

However, no method of transmission over the Internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

Data Retention

Our Retention

  • Appointment Records: Retained for business and legal compliance purposes as required by federal and state law

  • Fingerprint Images: May be retained temporarily for quality assurance and potential resubmission purposes

  • Payment Records: Retained in accordance with financial record-keeping requirements

FBI Retention

The FBI may permanently retain your fingerprints and associated information in the Next Generation Identification (NGI) system. While retained in NGI, your fingerprints may continue to be compared against other fingerprints submitted to or retained by the system.

Right to Access

You have the right to:

Right to Challenge FBI Records

If you believe your FBI criminal history record contains inaccurate or incomplete information, you have three options:

Option 1: Contact the Contributing Agency Contact the state or federal agency that submitted the information to the FBI. For state information, contact your state's Identification Bureau. For federal information, contact the original arresting agency or court.

Option 2: Electronic Challenge to FBI

  1. Go to https://www.edo.cjis.gov

  2. Follow the steps under "Challenging Your Identity History Summary"

  3. Receive a response electronically or by mail

Option 3: Written Challenge to FBI Mail your written request with supporting documentation to:

Your written request should clearly identify the inaccurate or incomplete information and include copies of supporting documentation (such as court records).

Right to Correction

You have the right to:

  • Request correction of inaccurate personal information

  • Complete incomplete records

  • Be afforded a reasonable amount of time to correct or complete records before denial of employment or benefits based on information in your criminal history record

Right to Be Informed

You have the right to:

  • Receive written notice of the procedures for obtaining changes to your FBI criminal history record (28 CFR 16.34)

  • Be informed of how your information will be used, shared, and retained

  • Receive this Privacy Policy and FBI Privacy Act Statement

Authorized Use Expectation

You have the right to expect that officials receiving your criminal history record will:

  • Use it only for authorized purposes

  • Not retain or disseminate it in violation of federal statute, regulation, executive order, or rules established by the National Crime Prevention and Privacy Compact Council

By using our fingerprinting services, you acknowledge that:

  1. You have read and understood this Privacy Policy

  2. You consent to the collection, use, and disclosure of your information as described

  3. You understand your fingerprints may be retained in FBI databases and compared against other records

  4. You have been provided the opportunity to review and challenge your FBI criminal history record

  5. You understand the authorized uses and routine disclosures of your information
